Filing 67 MEMORANDUM AND ORDER re 64 Motion for Summary Judgment - For the reasons set forth above (SEE ATTACHED MEMORANDUM AND ORDER for details), the Court GRANTS the defendants motion for summary judgment and DISMISSES all of plaintiff's claims with prejudice. Although plaintiff paid the filing fee to commence this action, the Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that, should he seek in forma pauperis status for the purpose of an appeal, any appeal from this order would not b e taken in good faith and therefore in forma pauperis status is denied. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of the Court is directed to send a copy of this Order to the pro se plaintiff and mark this case closed.
