ORDER denying 2 Motion for Preliminary Injunction; granting 3 Motion for Leave to Proceed in forma pauperis; For the reasons set forth above, Plaintiff's application to proceed in forma pauperis is GRANTED and his application for a Preli minary Injunction is DENIED. The Court ORDERS that the Clerk of the Court serve a copy of the Complaint together with this Order on the Suffolk County Attorney. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Ord er would not be taken in good faith and therefore in forma pauperis status is DENIED for the purpose of any appeal.
