Filing 140 ORDER denying 137 Motion to Dismiss for Lack of Jurisdiction; denying 137 Motion to Remand to State Court. For the foregoing reasons, Plaintiff's motion to strike the jury demand is denied. Plaintiff's motion to strike certain exhibits is granted with respect to Exhibits Z.2, Z.4 and Z.5, and denied in all other respects. Defendants' motion and March 9, 2012, letter application are denied in their entirety. Defendants must submit to the Court and to Plaintiff by Wednesday, Ap ril 25, 2012, hard copies of each of their documentary exhibits to be offered at trial. As required by section six of the Court's May 5, 2008, Pre-trial Scheduling Order, the exhibits must be tabbed and included in a binder for easy reference. Filing 87 MEMORANDUM OPINION: Plaintiff's claims against defendants Lovett, Begley, Banzhaf, Reichardt, Thomas Begley & Associates, Hartsfield Capital Group, Argosy Capital Securities (formerly Hartsfield Capital Securities) and Mansell Capital Partners w ill be severed and transferred to the Northern District of Georgia pursuant to Rule 21 of the F.R.C.P. and 28 U.S.C. 1404(a). Plaintiff's claims against defendant Assemi will be dismissed with prejudice and Defendant Assemi's counterclaim w ill be dismissed with leave to replead in this Court. Count eight will be dismissed as against defendant Morrow and TJ Morrow PC. The motions are denied in all other respects.
