Filing 67 MEMORANDUM AND ORDER granting in part and denying in part 48 Motion for Summary Judgment. For the foregoing reasons, Defendants Motion for Summary Judgment is GRANTED in part and DENIED in part. Plaintiffs retaliation claims under Section 806 of Sarbanes-Oxley survive against all Defendants except Escriba. The Clerk of the Court is directed to close the motion at Docket Number 48. Filing 44 MEMORANDUM OPINION AND ORDER: For the foregoing reasons, the Court concludes that the Dodd-Frank amendment to Section 806 of Sarbanes-Oxley applies retroactively as a clarification of the statute. Plaintiff, as an employee of the subsidiary of a publ ic company whose financial information is included in the consolidated financial statements of the public company, is a covered employee under Section 806. The Court therefore has subject matter jurisdiction over this case, and Defendants motion to d ismiss is denied. The parties are to submit a joint letter to the Court no later than July 23, 2012 stating what steps will be necessary to prepare the case for trial, including any period of additional discovery and whether the parties wish to file any further dispositive motions.
