Filing 146 OPINION re: 131 FIRST MOTION to Dismiss Second Amended Complaint as to Dr. Merrell filed by Woodson Merrell, M.D. As Plaintiff's claims are both substantively inadequate and time-barred, the claims against Merrell are dismissed wit h prejudice and the entry of final judgment is granted. Robbins' invitation at oral argument for the Court to invalidate the entire SAC is declined - only the claims against Merrell are dismissed with prejudice and the rest of the allegations and claims in the SAC constitute the operative complaint.
