Filing 43 OPINION & ORDER: Plaintiff's claims against the City Defendants and the Allied Barton Defendants are dismissed in their entirety. Plaintiffs claims against the State Defendants are also dismissed, with the exception of: (1) plaintiff's 7; 1983 claim against the State Defendants for false arrest; (2) plaintiff's state law claim against the State Defendants for false arrest; (3) plaintiff's § 1983 claim against defendant Farrugia for excessive force; and (4) plaintiff& #039;s state law claim against defendant Farrugia for assault and battery, all of which survive. The Clerk of Court is instructed to terminate the motions pending at docket entries number 20 and 22. No later than April 2, 2012, the parties shall subm it a proposed case management plan for the Court's approval. A pretrial conference in this matter is scheduled for April 5, 2012, at 4:00p.m. at the U.S. Courthouse, 500 Pearl Street, New York, New York 10007. (Signed by Judge Paul A.
