April 17, 2012 Opinion or Order Filing 11 MEMORANDUM AND ORDER granting in part and denying in part 3 Motion to Dismiss. For the foregoing reasons, Sallie Mae's motion to dismiss Counts 3, 4, 6, and 8 is GRANTED and its motion to dismiss the remaining Counts is DENIED. Noting the abse nce, at this stage of the litigation, of significant factual dispute, we take the additional step of REFERRING this case to Magistrate Judge Frank Maas in the hope that the parties can resolve the dispute consensually.
