Filing 27 OPINION re: 14 MOTION to Dismiss filed by Brian Fisher, Glenn Goord, John B. Lempke. Based upon the conclusions set forth above, the Defendants' motion to dismiss is granted. When an amended complaint would be futile, a court need not grant l eave to replead. Because even a liberal reading of the Complaint suggests that no valid claim could be stated against the named Defendants, Fate's claims against as to these Defendants will be dismissed with prejudice.
