I have considered the parties' other arguments and find them without merit. Augstein's motion for summary judgment is GRANTED insofar as he seeks a declaration that the reward was an o ffer and sanctions for the negligent destruction of the hard drive. The motion is otherwise DENIED. The trial is scheduled to begin on November 26, 2012, at 9:30 A.M. The Clerk of Court is instructed to close the open motions and remove them from my docket.
