Filing 40 ORDER re: 39 Letter filed by Bledar Haxhia. The Court has received a letter from Petitioner Bledar Haxhia, dated June 24, 2020, written without the assistance of counsel. (ECF No. 39.) In the letter, Petitioner requests the Court's guidan ce as to how to proceed in the above-captioned matter. Judges are forbidden to give anyone legal advice. See Plilier v. Ford, 542 U.S. 225, 231 (2004) (requiring judges to advise pro se litigants "would undermine district judges' role as impartial decisionmakers"). The Court therefore declines to respond to the substance of Petitioners letter. SO ORDERED. (Signed by Judge Kimba M. Wood on 7/15/2020) (mml) |
Filing 22 OPINION & ORDER: For the reasons stated above, the petition for a writ of habeas corpus is GRANTED. Haxhia shall be released unless the state commences prosecution or takes other action appropriate in light of this decision within sixty days. A ce rtificate of appealability regarding the alleged evidentiary errors will not issue because Petitioner failed to make a substantial showing of a denial of a constitutional right. 28 U.S.C. § 2253. The Clerk of Court is directed to close this case; all pending motions are moot. (Signed by Judge Kimba M. Wood on 3/2/2015) (tro) |
