Filing 21 MEMORANDUM AND ORDER granting 18 Motion to Dismiss. For the foregoing reasons, plaintiffs motion for appointment of counsel is DENIED and defendants' motion to dismiss is GRANTED. Defendants' counsel is ordered to mail to the plaintiff co pies of all unpublished authorities cited herein. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
