ORDER adopting 90 Report and Recommendations. Judge Pitman's August 17, 2016 R & R (Dkt. No. 90) is adopted by this Court in its entirety. The Clerk of the Court is respectfully directed to enter judgment in favor of Plaintiff as aga inst Defendants Jaffrey and Wingate, jointly and severally, in accordance with the R & R. The Clerk of Court is further directed to close this case. The parties' failure to file written objections precludes appellate review of this decision. See United States v. MEMORANDUM OPINION & ORDER: re: 53 MOTION for Default Judgment as to All Defendants filed by Gary Walpert. For the reasons stated above, Defendants' motion to dismiss the Amended Complaint is denied; Plaintiff's motion to drop USDFM as a defendant is granted; and Plaintiff's motion for a default judgment is granted as to Defendants Jaffrey and Wingate. Defendants'Answer to the Amended Complaint is stricken as to Defendants Jaffrey and Wingate on all five cau ses of action in the Amended Complaint, and this opinion and order constitutes an order of default on these causes of action as to these defendants. This case will be referred to the assigned Magistrate Judge for an inquest on damages concerning Plai ntiff's claims, and for a determination as to whether Wingate is entitled to an offset based on its Counterclaim. The Clerk of the Court is directed to terminate the motion (Dkt. No. 53). SO ORDERED. (Signed by Judge Paul G. Gardephe on 8/28/2015) (ama)
