ENDORSEMENT: The Bijan Nassi Entities are granted leave to serve a request for document production, no later than March 19, 2014, on Craig Nassi, who shall respond to the request no later than April 2, 2014. The Bijan Nassi Entities shall provide copies of anything they receive to PC-Palladio no later than April 4, 2014. To the extent Craig Nassi discloses any documents that were not previously disclosed to PC-Palladio, PC-Palladio shall make any motion to preclude such documents by the deadline for submission of the joint pretrial order and related filings. The Bijan Nassi Entities application for additional discovery is otherwise DENIED. In light of the discovery that PC-Palladio has agreed to provide the Bijan Nassi Parties, there is no good cause to require PC-Palladio to disclose all documents related to BCN Development, Prado Corp., and Metropolitan Antiques or all discovery it has received in this case. With respect to the former request, the question to be tried pertains to whether Bijan Nassi made loans to Craig Nassi, not to those entities; what, if anything, Craig Nassi did with the loan proceeds has little or no bearing on that question. And given the time frames in question, the documents are not even likely to shed light on what Craig Nassi did with the loan proceeds. Finally, the dispute over subpoenas to the third party banks is not ripe for the Court's intervention, but the Court notes that the Bijan Nassi Parties had ample opportunity to obtain the bank records--or to seek leave to obtain the bank records--earlier in this litigation. November 26, 2013 Opinion or Order Filing 86 ORDER: On November 26, 2013, the Court held a conference regarding, inter alia, Judgment Creditor's Motion for an order enforcing judgment against BCN Management LLC and Caffettino LLC (the "alter ego" motion). (Docket No. 58). In opposition to this motion, Judgment Debtor stated that other individuals possess interests in these entities, including Eli Tenenbaum in Caffettino LLC. (See Docket No. 78). It is hereby ordered that Judgment Creditor shall submit a supplemental memorandum of law, not to exceed five pages, addressing which party has the burden of showing there are no other entities with interests in BCN Management LLC and Caffetino LLC by December 5, 2013. Pending the resolution of the alter ego motion, the existing restraints on the accounts of BCN Management LLC and Caffettino LLC at Amalgamated Bank shall remain in place. At the conference, the Court also addressed Judgment Creditor's motion for a turnover order and accounting of Judgment Debtor's assets. (Docket No. 80). The Court granted Judgment Creditor's application for an accounting of assets listed in the financial statement attached to Sol Goldman Investments LLC's November 19, 2013 response to an information subpoena. The Court did not rule on the turnover order, however. By December 12, 2013, Judgment Debtor shall submit any opposition to Judgment Creditors motion for a turnover order. In this same submission, Judgment Debtor shall also submit any opposition to Judgment Creditor's supplemental submission regarding the appropriate burden on the alter ego motion. This combined memorandum shall not exceed twenty pages. Judgment Creditor shall serve a copy of this Order on Amalgamated Bank and promptly file proof of such service. The Clerk of Court shall mail a copy of this Order to Judgment Debtor. October 23, 2013 Opinion or Order Filing 40 ORDER: On October 22, 2013, this Court issued an order which memorialized an order issued on the record at the conference held earlier in the day directing one or more attorneys from Tarter Krinsky & Drogin LLP ("Tarter Krinsky") to file one or more affidavits representing that he, she, or they personally reviewed the documents and materials referenced in the Court's Order of October 10, 2013, and that all responsive documents and materials were produced to the Plaintiff-Judgment-Creditor in accordance with that Order (Docket No. 39). Before that order was issued, Jared Wachtler, a lawyer from Tarter Krinsky, filed an affidavit regarding the assistance he provided Craig Nassi in identifying documents responsive to the subpoena in this case (Docket No. 38). Mr. Wachtler's affidavit does not unambiguously certify, however, that Tarter Krinsky complied with the terms of the Court's October 10, 2013 Order. He states only that he "personally assisted" Craig Nassi "in identifying documents responsive to the subpoena duces tecum" at two locations associated with Mr. Nassi and that "[a]ll of these documents have been produced." (Docket No. 38, 3 (emphasis added)). The affidavit does not unambiguously attest to a review of all documents and materials at the two relevant locations for responsive items, let alone attest that all responsive items at the two locations were produced. Further, the affidavit fails to certify that all items responsive to the subpoena in the possession or custody of Tarter Krinsky were produced, as required by the October 10, 2013 Order. Tarter Krinsky is therefore ORDERED to file one or more supplemental affidavits from people with personal knowledge that all documents and materials at the two locations associated with Mr. Nassi were reviewed for responsive items and that all responsive items at the two locations were produced; and that all items responsive to the subpoena in the possession or custody of Tarter Krinsky were produced.
