Filing 80 OPINION AND ORDER re: 45 MOTION for Partial Summary Judgment to strike affirmative defense filed by National Photo Group, L.L.C., BWP Media USA Inc. For the foregoing reasons, it is hereby ordered that BWP and NPG's motion fo r partial summary judgment is GRANTED IN PART and DENIED IN PART. Specifically, Defendants are barred from asserting a defense under 17 U.S.C. § 512(c) as to FSO for any infringement occurring before November 5, 2012, and as to HFS for any infringement occurring before December 5, 2013. The motion to dismiss for lack of personal jurisdiction is GRANTED, and the c laims against Hollywood.com Holdings, LLC; R&S Investments, LLC; Hollywood Media Corp.; and individual defendants Mitchell Rubenstein and Laurie S. Silvers are DISMISSED. The motion to dismiss for failure to state a claim is GRANTED as to the RICO claims and DENIED as to the remainder of the claims. Defendants shall answer the remaining claims in the complaint by December 12, 2014. The Clerk of Court is directed to terminate the motion at docket number 18. SO ORDERED.
