December 15, 2015 Opinion or Order Filing 114 OPINION & ORDER: For the foregoing reasons, the Court awards Thor $165,544.78 in attorneys' fees and costs, as well as prejudgment interest on the Goonetillekes' $2,067,288.89 liability, accruing at a rate of 9% since July 2, 2014. October 2, 2015 Opinion or Order Filing 95 OPINION & ORDER: For the reasons set forth above, the Court grants Thor's motion for summary judgment on its breach of guaranty claim, and denies the Goonetillekes' motion for summary judgment on that claim. The Goonetillekes are liabl e to Thor on that claim for $2,067,288.99. The Court further directs Thor to submit a letter by October 7, 2015, notifying the Court as to whether it intends to pursue its separate costs of enforcement claim; if so, in what manner and on what timetable; and whether there are any additional matters that the Court must address before closing the case. Defendants are directed to respond by letter by October 14, 2015. The Clerk of Court is respectfully directed to terminate the motions pending at docket numbers 67 and 74. March 3, 2015 Opinion or Order Filing 42 OPINION & ORDER #105287: This order resolves a discovery dispute that the parties first addressed at a conference held on February 11, 2015, and thereafter in letter-memoranda, which the Court had invited. See Dkt. 32, 37. The Court, therefore, rul es that DVD Depot's obligation to pay rent was not excused. There is, accordingly, no charter in this action for authorizing discovery into the subject of Thor's alleged interference with DVD Depot's enjoyment of the premises.
