Filing 93 MEMORANDUM AND ORDER. Although "exclusion [of expert testimony] remains 'the exception rather than the rule,"' Vazquez v. City of New York, No. 10-CV-6277 (JMF), 2014 WL 4388497, at *12 (S.D.N.Y. Sept. 5, 2014) (quoting Floyd v. C ity of New York, 861 F. Supp. 2d 274, 287 (S.D.N.Y. 2012)), the Court finds that Dr. Pugh's testimony does not "rest[] on a reliable foundation" in light of the significant problems identified above. See Daubert, 509 U.S. at 597. For these reasons, Defendants' motion to exclude the testimony of Dr. Pugh is GRANTED. This resolves Dkt. No. 69. So ordered. Granting 69 Motion to Preclude. Filing 92 MEMORANDUM AND ORDER. For the foregoing reasons, Defendants' motion is GRANTED with respect to Plaintiff's 90/180 claim.
