MEMORANDUM OPINION AND ORDER re: 115 FIRST MOTION for Summary Judgment filed by CIT Bank, N.A. For the foregoing reasons, Plaintiff's motion for summary judgment is granted to the extent that it seeks a determination that Plaintiff is entitl ed to foreclose on Min's interest in the Property. It is denied without prejudice, pending the resolution of the remaining default judgment motion practice, to the extent it seeks a computation of damages and entry of a judgment of foreclosure a nd sale. Plaintiff's motion for default judgment is denied without prejudice to renewal in compliance with the Court's separate order to be entered contemporaneously with this Memorandum Opinion and Order. The Clerk of Court is requested to update the docket to reflect that this case is not stayed in its entirety. Only certain requirements related to final pre-trial conference preparation have been stayed. (See Docket Entry No. 125.) Docket Entry No. 115 is resolved. SO ORDERED. MEMORANDUM OPINION AND ORDER re: 72 MOTION to Set Aside Default and Dismiss. filed by Ji Youn Min, 57 MOTION for Default Judgment as to Defendants. filed by Onewest Bank N.A. For the foregoing reasons, the Court gran ts Min's motion to vacate entry of default, denies Min's motion to dismiss for lack of standing and failure to state a claim, and denies Plaintiff's motion for default judgment without prejudice. The Court grants Plaintiff's requ est to amend the case caption by replacing"OneWest Bank N.A." with Plaintiff's new name "CIT Bank, N.A." and striking Defendants United States of America (Eastern District), New York Supreme Court, New York State Department of Taxation and Finance, Ming Deng, and "John Doe No. 1" through "John Doe No. 10," as against which this action is dismissed without prejudice. The Clerk of Court is respectfully directed to amend the case caption on the docke t accordingly. The initial pretrial conference in this action is scheduled for October 21, 2016, at 2:30 PM. Counsel for Plaintiff and Min are directed to confer and make their pre-conference submission in accordance with the Initial Conference Ord er. (Docket Entry No. 5.) (As further set forth in this Order.)
