OPINION AND ORDER re: 10 MOTION to Dismiss or in the alternative. MOTION to Compel Arbitration filed by Emerging Managers Group, L.P., Emg Capital, LLC, 5 MOTION for Preliminary Injunction . MOTION for Per manent Injunction filed by Pictet Funds (Europe) S.A., Pictet Overseas Inc. For the foregoing reasons, plaintiffs' motion for a preliminary injunction is GRANTED and defendants' motion to dismiss is DENIED. The Clerk of Court i s directed to close these motions [Docket Nos. 5 and 10]. The parties are directed to confer and report back to the court by December 8, 2014, indicating whether they consent to the preliminary injunction being made permanent and to the entry of a final judgment in this case.
