September 25, 2015 Opinion or Order Filing 32 AMENDED ORDER for 25 Report and Recommendation: that the Court hereby adopts Magistrate Judge Peck's Report and Recommendation and denies Mr. Patterson's motion made pursuant to 28 U.S.C. § 2255 for the reasons set forth in Magis trate Judge Peck's Report and Recommendation. Furthermore, because petitioner has not at this time made a substantial showing of a denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. § 2253. The Court certifies, pursuant to 28 U.S.C. § 1915(a) (3), that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962) The Clerk of Court is hereby instructed to close document number 183 on the docket of this case. (Signed by Judge Jed S.
