Filing 121 OPINION AND ORDER: Having considered the full record, including certain additional exhibits submitted by the parties, the Court concludes that Plaintiff failed to meet her burden to show that she had an organically- or physically-based disability un der Unums Long Term Disability Plan, and that Unums denial of benefits was not arbitrary and capricious. Accordingly, Plaintiffs motion is DENIED and Defendants motion is GRANTED. Judgment will be entered in favor of Defendants. The Clerk of Court is directed to terminate all pending motions, adjourn all remaining dates, and close this case. (Signed by Judge Katherine Polk Failla on 9/29/2016) (cla) |
