May 12, 2015 Opinion or Order Filing 21 MEMORANDUM AND ORDER granting in part and denying in part 10 Motion to Dismiss. The defendants' motion to dismiss is GRANTED in part and DENIED in part as follows: the claims for malicious prosecution, excessive force, and assault are dismiss ed, as is the Monell claim; the motion is denied with respect to the false arrest claim and the First Amendment retaliation claim.
