The defendants' motion to dismiss is GRANTED in part and DENIED in part as follows: the claims for malicious prosecution, excessive force, and assault are dismiss ed, as is the Monell claim; the motion is denied with respect to the false arrest claim and the First Amendment retaliation claim.
