Filing 24 MEMORANDUM OPINION AND ORDER re: 12 MOTION to Dismiss pursuant to Fed. R. Civ. P. 12(b)(6), filed by The City of New York. For the foregoing reasons, the City of New York's motion to dismiss (ECF No. 12) is granted and Plaintiff& #039;s complaint is dismissed in its entirety. The Clerk of Court is instructed to enter judgment accordingly and to close the case. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
