OPINION AND ORDER re: 28 MOTION to Stay All Proceedings filed by Hess Oil Virgin islands Corp. & Subsidiaries, 23 MOTION to Dismiss Complaint pursuant to F.R.C.P. 12(b)(1), (2), and (3), and forum non conveniens filed by The Virgin Islands Bureau of Internal Revenue, The Government of the United States Virgin Islands. For the foregoing reasons, Defendants' motion to dismiss for lack of subject matter jurisdiction is GRANTED and Plaintiff's motion to stay is DENIED as moot.
