MEMORANDUM OPINION AND ORDER re: 13 CROSS MOTION to Vacate Arbitration and in Opposition to Petitioner's Petition to Confirm Award, filed by Westchester Hills Golf Club, Inc., 27 CROSS MOTION for Summary Judgment . fil ed by Westchester Hills Golf Club, Inc., 20 MOTION for Summary Judgment , filed by William Granfield, Unite Here Local 100, 42 LETTER MOTION to Adjourn Conference addressed to Judge Laura Taylor Swain from Debra L. Wab nik dated February 9, 2016, filed by Westchester Hills Golf Club, Inc. For the foregoing reasons, Petitioners' motion to confirm the 2015 Award is granted and Respondent's cross-motion to vacate the award is denied. WHGC is therefore ord ered to restore Cremin to his position as a bartender, effective immediately, with full back pay, less unemployment compensation benefits, senority credit, and commensurate fringe benefits, plus pre-judgment interest at a rate of 9 percent per annum from January 28, 2015, to the date judgment is entered in this matter. Petitioners' request for attorneys' fees and costs is denied. The Clerk of Court is requested to enter judgment in favor of Petitioners accordingly and close this case. The pre-trial conference scheduled for February 11, 2016, is cancelled. This Order resolves docket entry nos. 13, 20, 27, and 42. (As further set forth in this Order.)
