Filing 11 MEMORANDUM OPINION AND ORDER: For the foregoing reasons, Antoniou was not taken into immigration custody "when [he was] released" from criminal custody, making mandatory detention improper. He has the right pursuant to section 236(a) of the INA to have an impartial adjudicator decide if he may be released during the pendency of his removal proceedings. Accordingly, the Government is ordered to afford Antoniou a bond hearing within fifteen (15) days. The Clerk of the Court is directed to close this case. SO ORDERED. (Signed by Judge Shira A.
