OPINION AND ORDER re: 21 MOTION to Remand (refiled) to Supreme Court of New York, Bronx County, filed by MSS Construction Corp. All four factors favor joinder and permissive joinder under Rule 20(a)(2) is thus appropriate. The prope r addition of the non-diverse Defendants, however, destroys complete diversity between the parties and requires that the action be remanded pursuant to 28 U.S.C. § 1447(e). For the foregoing reasons, Plaintiffs motion to remand the case to New Y ork Supreme Court is GRANTED. The Clerk of the Court is respectfully directed to terminate the motion, Doc. 21, and REMAND the case to the Supreme Court of the State of New York, Bronx County.
