ORDER granting in part and denying in part #75 Motion for Reconsideration. Petitioner moves to reconsider this Court's Order of January 26, 2017 and to hold respondent in contempt for failure to pay a money judgment for $110,758.69. Petitioner adheres to her view that a judgment for the payment of a sum certain issued by a district court is enforceable through the court's civil contempt powers. This Court disagrees. This Court concludes that the judgment at issue is for a sum certain awarded as attorneys' fees and expenses to a prevailing party and is not enforceable through the Court's contempt powers. Within 14 days, the petitioner or her counsel shall submit to the Court an affidavit setting forth in detail the content of the information that was provided by respondent (including any screenshot) and the information that was omitted by respondent, together with proof of service of the subpoena. ORDER: I have the letters from counsel for petitioner and the respondent pro se. The judgment entered by the Clerk of this Court is a simple money judgment only enforceable as such. The law of this Circuit is as follows: "A suit to enforce a judgment rendered by a federal court exercising federal question jurisdiction may not be brought in federal court unless the enforcement suit has a basis of federal jurisdiction independent of the fact that the original suit was on a federal question. See Stiller v. Hardman, 324 F.2d 626, 628 (2d Cir.1963) ([A] suit on a judgment [rendered by a federal court exercising federal question jurisdiction] does not involve a federal question, however important federal questions may have been to the resolution of the original controversy.)." MEMORANDUM AND ORDER: The Court finds that petitioner has proven by a preponderance of the evidence that (1) BAB is a habitual resident of Canada; (2) the retention of BAB in the United States violated petitioner's custody rights under Quebec law; and (3) petitioner was exercising these rights at the time of the retention. The Court also finds that respondent has not proven by a preponderance of the evidence his defense under Article 13(a) of the Convention, that petitioner consented or subsequently acquiesced to the retention. Because petitioner has established her case under the Hague Convention and respondent has failed to prove his Article 13(a) defense, the petition is GRANTED. On or after August 14, 2015, the Clerk of Court shall deliver the passport of BAB to Rong Kohtz, attorney for petitioner, and shall return the passport of respondent to respondent's attorney, Jason Advocate.
