July 19, 2017	Filing 32 OPINION & ORDER re: 18 MOTION to Dismiss the Amended Complaint filed by Xerox Corporation, 5 MOTION to Dismiss Complaint filed by Xerox Corporation. For the foregoing reasons, Xerox's motion to dismiss is granted in part and denied in part. The Court dismisses Hadami's claims for breach of contract and of the implied covenant of good faith and fair dealing, for gross negligence, and for tortious interference with prospective economic advantage. The Co urt denies the motion to dismiss Hadami's claim for fraud. Pursuant to the civil case management plan and scheduling order governing this action, Dkt. 17, fact discovery will end 270 days from today-the date of Court's resolution of Xerox& #039;s motion to dismiss. As such, the deadline to complete fact discovery is April 15, 2018. The Court also schedules a case management conference for May 15, 2018, at 3:30 p.m. The Clerk of Court is respectfully directed to terminate the motions pending at Dkts. 5 and 18. SO ORDERED.
