The parties' request to file the settlement agreement under seal is granted. Any application to reopen must be filed within sixty (60) days of this Order; any application to reopen filed t hereafter may be denied solely on that basis. Further, the parties are advised that if they wish the Court to retain jurisdiction in this matter for purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court within the next sixty (60) days with a request that the agreement be "so ordered" by the Court. OPINION AND ORDER re: 18 MOTION to Dismiss for Failure to State a Claim: Defendants' motion to dismiss is GRANTED with respect to any claims for fraud in the premarket approval process, design defect, manufacturing defect, and ina dequate warning label. Additionally, Defendants' motion is GRANTED with respect to the dismissal of CarboMedics. Defendants' motion is DENIED with respect to Plaintiffs' claim for failure to warn the FDA. Plaintiffs may file an amended complaint, if at all, on or before October 29, 2018. The Clerk of the Court is respectfully directed to terminate the motion, Doc. 18.
