OPINION AND ORDER re: 35 MOTION for Summary Judgment . filed by Central Avenue Nissan, Inc., James O'Rourke. Defendants' motion for summary judgment is GRANTED in part and DENIED in part. Specifically, the Court grants su mmary judgment on Torres's claims for discriminatory termination under the ADA and retaliation under Title VII and the NYSHRL, and otherwise denies summary judgment. Defendants' requests for oral argument are DENIED as moot. Docs. 36 and 43. The parties are directed to appear for a status conference on April 14, 2021 at 10:30 a.m. The parties are directed to dial (877) 411-9748 and enter access code 3029857, followed by the pound (#) sign. The Clerk of Court is respectfully direc ted to amend the caption of this action to replace James ORourke with James Rourke and terminate the motion. Doc. 35.
