December 15, 2020 Opinion or Order Filing 71 ORDER: On April 6, 2018, United Specialty Insurance Company brought this action for declaratory judgment against Lux Maintenance & Ren. Corp. ("Lux"), Cornell University, Rockefeller University, The Society of the New York Hos pital, Memorial Hospital for Cancer and Allied Diseases, and Manhattan Eye Ear & Throat Hospital ("Hospital Defendants"). Doc. 2. On November 20, 2019, the Court granted summary judgment to the Hospital Defendants. Doc. 59. On July 1 6, 2020, the Court granted in part the Hospital Defendants' request for attorney's fees. Doc. 68. On December 1, the Court ordered Plaintiff to show cause why the Court should not dismiss this action against Lux, the only remaining de fendant who had neither appeared nor answered, for failure to prosecute. On December 14, Plaintiff confirmed that there are no further issues to adjudicate in this case and asserted that it did not oppose dismissal of the claims against Lux. Accordingly, the Court dismisses the claims against Lux and respectfully directs the Clerk of Court to close the case. Lux Maintenance & Ren. Corp. terminated. July 16, 2020 Opinion or Order Filing 68 OPINION AND ORDER re: 63 MOTION for Attorney Fees . filed by Cornell University. For the reasons set forth above, the Court enters judgment in the amount of $9,989.00 to the Hospital Defendants. The Clerk of the Court is respectfully directed to terminate the motion, Doc. 63. November 20, 2019 Opinion or Order Filing 59 OPINION AND ORDER re: 43 MOTION for Summary Judgment filed by United Specialty Insuance Company, 51 MOTION for Summary Judgment filed by Cornell University. For the aforementioned reasons, the Hospital Defendants' ; motion for summary judgment, including their request for attorneys' fees, is GRANTED and USIC's motion for summary judgment is DENIED. The Hospital Defendants are hereby directed to submit, via affidavit, contemporaneous time records and other competent evidence, their application for attorneys' fees by December 19, 2019.
