ORDER TO SHOW CAUSE. It is hereby ORDERED, that the above-named defendants show cause before the Honorable Paul A. Crotty, at 40 Foley Square, courtroom 14C, at 10:45 a.m., on December 19, 2018, why an Order should not be issued pursuant to Rule 26 of the Federal Rules of Civil Procedure and the Court's inherent power, (1) Ordering the preservation until trial of the vehicle driven by Robert Lee Brown Jr. on July 26, 2018 with Indiana license plate no. 2596954 and VIN no. 4V4NC9TH7BN; and (2) Permitting Miller Seabrooks, his attorneys, and a vehicle inspection service and/or mechanic, to immediately preserve, inspect, and photograph the vehicle driven by Robert Lee Brown Jr., before any defendant or non-party makes or causes to be made any repairs, changes, or alterations to said vehicle. IT IS FURTHER ORDERED, that pending the determination of this Order to Show Cause and the completion of the inspection and imaging referred to in paragraph "(2)" above, the defendants shall not make or cause to be made any repairs, changes, or alterations to said vehicle identified in paragraph "(2)" above. IT IS FURTHER ORDERED, that service of a copy of this Order to Show Cause and the papers upon which it was issued so that they are received by Defendant Robert Lee Brown Jr. and Defendant Evans Trucking Company on or before November 30, 2018, shall be deemed good and sufficient service thereof.
