February 14, 2022 Opinion or Order Filing 93 ORDER OF DISMISSAL... It is ORDERED that the above-entitled action be and is hereby DISMISSED and discontinued without costs, and without prejudice to the right to reopen the action within sixty days of the date of this Order if the settlement is not consummated. To be clear, any application to reopen must be filed by the aforementioned deadline; any application to reopen filed thereafter may be denied solely on that basis. Further, requests to extend the deadline to reopen are unlikely to be granted. If the parties wish for the Court to retain jurisdiction for the purposes of enforcing any settlement agreement, they must submit the settlement agreement to the Court by the deadline to reopen to be "so ordered" by the Court. Per Paragraph 4(B) of the Court's Individual Rules and Practices for Civil Cases, unless the Court orders otherwise, the Court will not retain jurisdiction to enforce a settlement agreement unless it is made part of the public record. December 20, 2021 Opinion or Order Filing 89 ORDER. In light of the COVID-19 situation, the Court will not hold the upcoming conference in this case in person. Because the Court is closed on December 30, 2021, Counsel should submit their proposed case management plan and joint letter no late r than Wednesday, December 29, 2021, as directed in the Court's earlier Scheduling Order. In their joint letter, the parties should also indicate whether they can do without a conference altogether. If so, the Court may enter a case managemen t plan and scheduling order and the parties need not appear. If not, the Court will hold the initial conference by telephone, albeit perhaps at a different time. To that end, counsel should indicate in their joint letter dates and times during the week of the conference that they would be available for a telephone conference. In either case, counsel should review and comply with the procedures for telephone conferences set forth in the Court's Individual Rules and Practices for Civil Cases, available at https://nysd.uscourts.gov/hon-jesse-m-furman. November 8, 2021 Opinion or Order Filing 83 OPINION AND ORDER: re: 79 MOTION to Dismiss Plaintiff's Second Amended Complaint and to Stay Discovery. filed by JPMorgan Chase Bank N.A. For the reasons stated above, JPMorgans motion to dismiss is GRANTED in part and DENIE D in part. Specifically, the Court holds that Wilsons hostile work environment and race discrimination claims under the NYCHRL and NYSHRL cannot be dismissed, but her retaliation claims must be and are dismissed. Unless and until the Court ord ers otherwise, JPMorgan shall file its answer to Wilson's remaining claims within three weeks. By separate Order to be issued today, the Court will schedule an initial pretrial conference. The Clerk of Court is directed to terminate ECF No. 79 and to terminate Defendants Jamie Dimon, Jane and/or John Does 1-10, and XYZ Entities 1-10. So Ordered. (Signed by Judge Jesse M. March 10, 2021 Opinion or Order Filing 72 OPINION AND ORDER re: 60 MOTION to Dismiss the First Amended Complaint and to Stay Discovery filed by JPMorgan Chase Bank N.A., James Dimon. For the foregoing reasons, Defendants' motion to dismiss is GRANTED in its entirety. Nevertheless, mindful that leave to amend a complaint should be freely given when justice so requires, Fed. R. Civ. P. 15(a)(2), and that it is within the sound discretion of the district court to grant or deny leave to amend, Ahmed v. GEO USA LLC, No. 14-CV-7486 (JMF), 2015 WL 1408895, at *5 (S.D.N.Y. Mar. 27, 2015) (internal quotation marks omitted), the Court exercises its discretion and grants Wilson leave to amend. Put simply, the Court concludes that Wilson may be able to allege suffici ent additional facts to remedy at least some of the defects in her claims (e.g., by adding more of the particulars to the allegations in Paragraphs 24 and 78). Wilson shall file any Second Amended Complaint within thirty days of the date of this Opinion and Order. Should she fail to do so by that date, the Court will dismiss the case without further notice.
