June 28, 2021 Opinion or Order Filing 10 STIPULATION, IT IS HEREBY STIPULATED AND AGREED by and between Plaintiff and Defendant that: 1. Defendant's time to answer, move or otherwise respond to the Complaint in the above-captioned action is extended from June 24, 2021 to and including August 9, 2021; and 2. All applicable statutes of limitations and all other time-based limitations or defenses that are unexpired as of June 23, 2021 and that are applicable to the assertion of a potential claim by Plaintiff and any potential member of the proposed collective action in the Complaint under the Fair Labor Standards Act or New York Labor Law, and any defenses or counterclaims thereto, whether direct, contributory or vicariously (collectively, the "Time Based Defenses"), are hereby tolled and suspended from June 23, 2021 to and including the August 9, 2021 (the "Tolling Period"). At the conclusion of the Tolling Period, any applicable statutes of limitations periods shall once again resume running (i.e., any such limitations periods shall be deemed extended by a period of time equal to the duration of the 45 day tolling period prescribed hereunder). The tolling is not intended to, and shall not, revive any potential claim or defense that is or would be time-barred on or before June 23, 2021 by any applicable statute of limitations, laches or any other defense related to the passage of time.
