Petitioner's papers submitted in support of its pending motion to confirm arbitration award are hereby deemed modified so as to also be treated as and in support of a motion for summary judgment ("Motion"). 2. Respondents do not object and hereby consent to the admission into evidence of the facts submitted in support of the Motion, as modified, as set forth in the Verified Petition and the Certification of Stephen Haoluvas dated August 3, 2021 and the exhibits submitted therewith and Petitioner's Statement of Material Facts in Support of Motion for Summary Judgment and to Confirm Arbitration Award dated August 20, 2021. 3. The materials cited in the Motion are not disputed. 4. Respondents shall submit no papers in opposition to the Petition or the Motion, as modified, and, subject to Petitioner's withdrawal of its request for costs and disbursements provided in paragraph 5 of this Stipulation, Respondents consent to the relief requested therein. 5. Petitioner hereby withdraws its request for an award of costs and disbursements as provided in the Petition and/or the Motion. 6.
