Filing 10 ORDER granting #8 Letter Motion for Discovery It is hereby ORDERED that plaintiff may serve RCN with a Rule 45 subpoena to obtain defendant Doe's name and mailing address only. Plaintiff shall not seek defendants email address by subpoena or otherwise. Plaintiff may not serve a Rule 45 subpoena on any other ISP without further order of the Court. It is further ORDERED that defendant Doe shall have 30 days from the date of service of the Rule 45 subpoena and this Order upon him or her to file any motions contesting the subpoena (including a motion to quash or modify the subpoena). RCN may not turn over defendants identifying information to plaintiff before the expiration of this 30-day period. Additionally, if defendant or RCN files a motion to quash or modify the subpoena, RCN may not turn over any responsive information to plaintiff until the issues have been addressed and the Court issues an order. It is further ORDERED that RCN shall preserve any subpoenaed information pending the resolution of any timely-filed motion to quash. It is further ORDERED that RCN shall confer with plaintiff and shall not assess any charge in advance of providing the information requested in the subpoena. If RCN receives a subpoena and elects to charge for the cost of production, it shall provide a billing summary and cost report to plaintiff. Filing 7 ORDER REGARDING GENERAL PRETRIAL MANAGEMENT: The above-referenced action has been referred to Magistrate Judge Barbara Moses for general pretrial management, including scheduling, discovery, non-dispositive pretrial motions, dispositive motions requiring a Report and Recommendation, and settlement, pursuant to 28 U.S.C. 636(b)(1)(A). All pretrial motions and applications must be made to Judge Moses and in compliance with this Court's Individual Practices in Civil Cases, available on the Court's website at https://nysd.uscourts.gov/hon-barbara-moses. There is no indication on the docket of this action that any defendant has been served with process, and thus no initial conference has taken place and no schedule has been set for motions or any other pretrial proceedings. Parties and counsel are cautioned: Once a discovery schedule has been issued, all discovery must be initiated in time to be concluded by the close of discovery set by the Court. Discovery applications, including letter-motions requesting discovery conferences,must be made promptly after the need for such an application arises and must comply with Local Civil Rule 37.2 and 2(b) of Judge Moses's Individual Practices. It is the Court's practice to decide discovery disputes at the Rule 37.2 conference, based on the parties' letters, unless a party requests or the Court requires more formal briefing. Absent extraordinary circumstances, discovery applications made later than 30 days prior to the close of discovery may be denied as untimely. Court conferences and hearings may be conducted by teleconference, videoconference, or in person. Teleconferences are held on the Court's AT&T line. If a teleconference is scheduled, the parties are directed to call (888) 557-8511 and enter the access code 7746387 a few minutes before the scheduled time and further set forth in this Order.
