OPINION AND ORDER denying 38 Motion for Partial Summary Judgment....For the reasons stated herein, the Court denies REI'S motion for partial summaryjudgment and grants Great American's cross-motion for summary judgment because of REI' ;s unreasonable and unexcused delay in notifying Great American of the AASP's suit. The Clerk of the Court is respectfully directed to terminate the pending motion (Dkt. No. 38), enter judgment for Defendant, and close this case. So Ordered. (Signed by Judge Kenneth M.
