OPINION AND ORDER: Defendants' Motion to Dismiss Plaintiffs breach of contract claim is DENIED as to the Corporate Defendants and GRANTED as to Defendant Lawrence Smith. Defendants' Motion to Dismiss Plaintiffs fraud claim is GRANTED. The Clerk of Court is respectfully directed to terminate the pending motion, (Doc. 12), and terminate Mr. Smith as a Defendant in the case.
