OPINION & ORDER re: 40 MOTION to Remand to State Court . filed by In the Matter of the Application of Hamshire Recreation, LLC and Hampshire Club, Inc., 43 CROSS MOTION to Dismiss . filed by The Village of Mamaroneck Zo ning Board of Appeals, The Village of Mamaroneck, The Village of Mamaroneck Board of Trustees. Plaintiffs' Motion to Remand is DENIED as moot. Defendants' Motion to Dismiss is GRANTED. Plaintiffs' federal claims are dismissed wit h prejudice and Plaintiffs' state law claims are hereby remanded to the New York Supreme Court.
