September 12, 2018 Opinion or Order Filing 92 OPINION & ORDER re: 75 MOTION to Dismiss , for Judgment on the Pleadings, and for Partial Summary Judgment filed by Mark Angarola, Tim Cowan, Lisa Mincak, Hewlett-Packard Company. For the foregoing reasons, Defendant's M otion is GRANTED in part and DENIED in part. It is granted insofar as it seeks dismissal of all claims against the Individual Defendants and dismissal of the state law claims against all Defendants. It is denied insofar as it seeks summary judgmen t on the issue of whether or not HP was Plaintiff's employer under the joint employer doctrine. In light of the fact that the parties were granted limited discovery on the issue of employment prior to briefing this motion, factual discovery o n Plaintiff's Title VII and ADEA claims is incomplete. The parties are therefore directed to confer and complete the attached Case Management Plan and submit it to Chambers on or before September 26, 2018. The Clerk of the Court is respectful ly requested to terminate the motion at ECF No. 75. The Clerk of the Court is further respectfully directed to terminate Defendants Mark Angarola, Tim Cowan, and Lisa Mincak, as the SAC is dismissed as against them with prejudice. The Clerk of the Court is also directed to mail a copy of this Opinion and Order to Plaintiff at his address as listed on ECF. SO ORDERED. (Lisa Mincak, Mark Angarola and Tim Cowan terminated.) September 22, 2017 Opinion or Order Filing 91 OPINION & ORDER re: 59 MOTION to Comply, filed by Asad Gilani. Despite Plaintiff's vague request, Global produced a copy of the contract requested. The contract appears to directly relate to Plaintiff's claims since it was purport edly executed during the relevant time frame referenced in the complaint. Plaintiff's sole objection to Defendants' response to the subpoena concerns Defendants' alleged resistance to his request to inspect the original document. Suc h request, however, lacks merit. Defendants represent the document provided to Plaintiff is a "true and correct copy" and after a "good faith" search of their records they are unable to produce the originally executed document. Accordingly, it is the Court's determination that Defendants have fully complied with Plaintiffs subpoena. Based on the foregoing, Plaintiffs motion seeking to compel nonparty Global to comply with a duly served subpoena is DENIED as moot. The Clerk of the Court is directed to terminate the motion at Doc.
