DECISION AND ORDER. Defendant's 21 motion for judgment on the pleadings is denied, except to the extent that Defendant seeks to dismiss the FDCPA claim for failing to allege that the debt sought to be collected was within the scope of consumer debt covered by the statute, and that claim is dismissed without prejudice, and Plaintiff is granted leave to file an amended complaint within twenty (20) days of the entry of this Decision and Order.
