DECISION AND ORDER: For the reasons stated in this decision and in the second Report & Recommendation, the defendants' motion to dismiss, Docket Item 30, is GRANTED in part and DENIED in part. Piechowicz's federal claims are dismissed. This Court declines to exercise supplemental jurisdiction over her remaining state law claims and those claims are REMANDED to New York State Supreme Court, Erie County. DECISION AND ORDER granting in part and denying in part 4 motion to dismiss; adopting in part 13 report and recommendations. The plaintiff may file an amended complaint against defendants Peter Kruszynski and the Lancaster Central School District on or before January 6, 2020.
