TEXT ORDER denying #2 Motion for Leave to Proceed in forma pauperis as incomplete. Plaintiff is not employed, lives with his wife, who receives food stamps in the amount $194 per week and financial assistance in the amount of $388.00 per month. Plaintiff indicates that his monthly expenses (rent and utilities) are $781 per month, yet, he fails to state how he is paying for such expenses in accordance with paragraph 9 of the motion since his monthly expenses exceed the amount of income he receives. Based on the lack of sufficient information, the Court cannot determine whether plaintiff has set forth sufficient indications of indigency, thus, plaintiff's in forma pauperis motion is DENIED. Plaintiff has until December 14, 2020 to (1) re-file his application using the Court's standard form with all of the relevant information included, or (2) pay the $400.00 filing fee. If plaintiff has not complied with either of these options by December 14, 2020, the Clerk of Court is directed to dismiss this case without prejudice and without further order. Signed by Hon.
