The Fourth Cause of Action is dismissed with prejudice, but the application is otherwise d enied. Within ten (10) days of the date of this Decision and Order, Plaintiff shall complete service on Defendant by sending a copy of the Summons and Complaint, by certified or registered mail, to both the Attorney General and the EEOC, and file pr oof of service with the Court. In the event that Plaintiff fails to do so, Defendant shall notify the Court in writing. The Clerk of the Court is directed to substitute Megan J. Brennan, Postmaster General, United States Postal Service, in place of Patrick Donahoe, and to terminate Donahoe as a party. Signed by Hon. Charles J. Siragusa on 3/31/17.
