TEXT ORDER granting #2 Motion to Amend Complaint. Plaintiff may file an amended complaint as of right pursuant to Federal Rule of Civil Procedure 15(a)(1). Rule 15(a)(1) provides, in relevant part, that "[a] party may amend its pleading once as a matter of course within . . . 21 days after serving it[.]" Plaintiff has not yet served the complaint on Defendant. Although Plaintiff may amend the complaint without the Court's leave at this stage, Plaintiff's motion is nonetheless granted. The Clerk of Court is directed to file the amended complaint, attached to the motion to amend at docket 2-1, on the docket as the amended complaint.To the extent that Plaintiff asserts that he has not received the previously issued summons (Dkt. 2 at 1), the Clerk of Court is directed to issue a summons for service on Defendant Strong Memorial Hospital, 601 Elmwood Avenue, Rochester, New York 14642 and send it to Plaintiff.
