MEMORANDUM OPINION: The defendants motion for summary judgment is granted with respect to plaintiffs claim based upon a denial of substantive due process, and with respect to their claim that Cocke County impliedly accepted a dedica tion of the roadways in Valley View Estates to the County. However, defendants motion for summary judgment with respect to plaintiffs claim based on a denial of equal protection is denied, and a trial will be necessary with respect to that discrete issue or claim.
