MEMORANDUM AND OPINION finding that based on the Courts findings of fact and conclusions of law as stated above, the Court FINDS in favor of defendants. Defendants will therefore NOT BE LIABLE fordamages to plaintiff. Plaintiff, how ever, will be ORDERED to reimburse Pegasus in theamount of $153,084.74, plus the statutory pre-judgment interest rate, for its expensesrelated to the Field. ORDER that Plaintiff's Motion for Summary Judgment 20 is hereby GRANTED to the extent that it is ORDERED as follows: (1) plaintiff is entitled to summary judgment on the issue of whetherplaintiff has to pay Pegasuss general e xpenses beyond those directlyrelated to the operation of the Field under Section 11.1 of thePurchase Agreement; and(2) plaintiff is entitled to summary judgment on the issue of whetherplaintiff has final policy-making authority with respect to personnel decisions at the Field.Plaintiffs motion is DENIED in all other respects, and this case will proceed to trial onthe remaining claims and issues.
