ORDER: For the reasons set forth in the accompanying Memorandum Opinion, the Court finds that there are no material issues of disputed fact and that Cricket is entitled to summary judgment in its favor as to all claims asserted against it. Cricket� 39;s motion 17 is therefore GRANTED. The defendant's pending motions to strike (Doc. Nos. 30 , 32 , 34 ) are DENIED AS MOOT. This matter DISMISSED. ORDER: Telephone conference held on 4/8/10, at which time the following matters were addressed: Parties shall file an agreed order or stipulation of dismissal of the plaintiff's state law claims. Plaintiff's deposition is scheduled the week of 4/12/2010, and the parties anticipate approximately four additional depositions, which they expect to schedule in April, but, in any event, no later than the 5/28/2010, deadline for completion for fact discovery. Parties will not use experts, and the deadlines for disclosure and discovery of experts, provided in the orders entered 8/31/2009 6 7 , have already passed and have not been extended. If, after the conclusion of the anticipated depositions, the parties are interested in participating in a settlement conference or want to address the potential for settlement and/or any other form of ADR, they shall schedule a conference call with the undersigned.
