For the reasons explained in the accompanying Memorandum Opinion, the petition is DENIED and this matter is DISMISSED WITH PREJUDICE. The petitioners motion for appointment of counsel 31 is DENIED AS MOOT. Because the petitioner has not made a "substantial showing of the denial of a constitutional right," 28 U.S.C. § 2253(c)(2), the Court DENIES a certificate of appealability (COA). The petitioner may, however, seek a COA directly from the Sixth Circuit Court of Appeals. Fed. R. App. P. 22(b)(1). This is the final order in this action for purposes of Fed. R. Civ. P. 58.
