On March 23, 2018, the court issued a Memorandum Decision and Order 104 granting in part defendant Life Time Fitnesss Motion for Partial Summary Judgment. The court granted summary judgment in favor of Life Time on plaintiff Jennifer Ngatuvais claim for intentional infliction of emotional distress. However, it stayed the remainder of the motion pendin g certification of certain questions to the Utah Supreme Court. The court now orders as follows: Defendants Motion for Summary Judgment on Ms. Ngatuvais claim for Negligent Infliction of Emotional Distress is DENIED. March 23, 2018 Opinion or Order Filing 104 MEMORANDUM DECISION AND ORDER: 1) Life Time's 67 motion for summary judgment is GRANTED as to Ms. Ngatuvai's claim for intentional infliction of emotional distress. 2) In all other respects, Life Time's motion for su mmary judgment is STAYED pending certification of controlling questions of law to the Utah Supreme Court. 3) The court will issue a separate order certifying questions to the Utah Supreme Court. 4) The parties are ORDERED to meet, confer, and file wi th the court a set of stipulated facts and questions of law to assist the court in drafting its certification order.
